PERMITS AND PASSES
Permits.
Work/Residence Permits are issued to any Non-Kenyan wishing to engage in employment in Kenya whether in gainful employment or voluntary service. The Work/Residence Permits issued by the Department are classified from A to M inclusive. They are issued under Kenya Citizenship and Immigration Act 2011 of Laws of Kenya. The following are the various classes of Permits and their respective requirements:
Class A.
Issued to persons who intend to engage in prospecting for minerals or mining.
Class A Requirements.
◦One should obtain or is assured to obtain the necessary licenses and registrations.
◦For renewals current license held for prospecting minerals and copy of PIN is required.
◦One has sufficient capital or resources for investment.
◦Processing Fee Kshs.10,000 non-refundable.
Class B.
Work permit issued to persons wishing to invest in Agriculture and Animal Husbandry.
Class B Requirements.
◦Proof of land ownership or leasehold interest in land for the purpose.
◦Proof of capital available for the purpose.
◦Clearance from relevant bodies.
◦For renewals current license held for prospecting minerals and copy of PIN is required.
◦Processing Fee Kshs.10,000 non-refundable.
◦Fee is Kshs. 100,000/= per year or part thereof.
Class D.
This issued to a person who is offered specific employment by a specific employer who is qualified to undertake that employment.
Class D Requirements.
•Copies of academic/professional certificates along with the CV.
•Evidence that the organization failed to fill the vacancy from the local labor market.
•Form 25 dully filled, signed and sealed by the company.
•Processing Fee Kshs.10,000 non-refundable.
•Fee is Ksh. 200,000/= per year or part thereof.
Class G.
Work permit issued to investors in specific trade, business or consultancy.
Class G Requirements.
◦Documentary proof of capital to be invested/already invested minimum of 100,000 US dollars or equivalent in any other currency.
◦Registration certificate of the company OR certificate of incorporation.
◦Copies of personal and company PIN (Personal Identification Number) if business is running.
◦For renewals; audited accounts for previous 2 years and a certificate of tax compliance from the Kenya Revenue Authority.
◦Processing Fee Kshs.10,000 non-refundable.
◦Fee is Kshs. 100,000/= per year or part thereof.
Class I.
Work/Residence permit issued to a member of missionary society approved by the Government of Kenya and whose presence is beneficial to the country.
Class I Requirements.
◦A copy of registration certificate of the organization.
◦Academic and professional certificates of the applicant.
◦Processing Fee Kshs.1,000 non-refundable.
◦Fee is Kshs. 5,000/= per year or part thereof.
Class K.
Residence permit issued to persons who have an assured income derived from sources outside and undertakes not to accept paid employment of any kind.
Class K Requirements.
◦Documentary proof of assured income is required for Class K.
◦Processing Fee Kshs.10,000 non-refundable.
◦Fee is Kshs. 100,000/= per year or part thereof.
Class M.
Work permit issued to Conventional Refugees.
Class M Requirements.
◦Recognition letters from UNHCR and Department of Refugee Affairs.
◦Processing Fee Gratis.
◦Permit is issued gratis.
GENERAL REQUIREMENTS.
◦Dully filled and signed application Form 3.
◦Covering letter from employer/self/organization depending on the class (as applicable)
◦Copies of the National Passport.
◦Two coloured Passport size photographs.
NOTE:
◦Application fees are only payable upon receipt of an approval notification.
◦Dully completed Entry Permit applications should be submitted at immigration Aliens counter 9 located atNyayo House Ground floor (south wing) for acknowledgement.
◦Applications for renewal of entry permits should be done three months prior to expiry date.
◦These permits are normally issued for period of two years.
◦A fee 40/= is payable for Application forms.
REQUIREMENTS AND WORK PROCESSES FOR PERMANENT RESIDENCY ELIGIBILITY AND REQUIREMENTS FOR PERMANENT RESIDENCY:
Under Section 37 of the Citizenship and Immigration Act, 2011, the following categories of applicants, their children and spouses detailed below are eligible upon meeting the prescribed requirements. In normal practice holders of permanent residency are expected to be domiciled in the country. CATEGORY: A (Ex-Citizens of Kenya) Applicants who were Kenya citizens at birth but now:
- Have renounced or lost citizenship status.
- Are denied the opportunity by their countries of domicile from holding dual citizenship
- The children and spouses of the above mentioned applicants.
Requirements

CATEGORY: B ( Lawful Residents of Kenya) Applicants who have held work permits for at least 7 years; (i) And have been continuously resident in the country for three years immediately preceding the permanent residence application. (ii) The children and spouses of the above mentioned applicants. Requirements Applicants must provide proof of lawful residence on work permits for a minimum of 7 years and with continuous 3 years residency in Kenya preceding the application for permanent residency. Applicants must demonstrate a strong position to make tangible contribution to socio-economic development of the country hence priority will be given to investors and highly qualified professionals. In, this framework, applicants may be required to appear in person for interview to confirm or verify these facts. Documentary Requirements:

Applicants must give ample proof of marriage and family life besides documentation furnished. NOTE: A joint sworn Affidavit by the spouses should be attached if marriage was not solemnized in Kenya.
PASSES:
STUDENT PASSES:
This document issued to person(s) seeking to enter and remain in the country for the purpose of receiving education or training at an educational or training establishment within the country by which he/she has been accepted as a student/pupil.
STUDENT PASSES REQUIREMENTS.
1.Application form(form 8) dully filled signed and stamped
2.Cover/forwarding letter from school stating the course and course duration
3.Copy of the passport • biodata pages • visa page
4.Two passport size photos
5.Commitment letter from parent/legal guardian/sponsor
6.6. The institution applying must be registered as an educational establishment. If the institution is relatively new a copy of registration must be submitted together with the application .
FEE FOR STUDENT PASSES:

DEPENDANT PASSES:
DEPENDANT PASS REQUIREMENTS.
◦The applicant must be Kenyan Holder of valid entry permit Exempted person under Immunities Act (Cap. 179) and who are covered under section 4(3) (a) to (g) .
◦Application form dully filled and signed
◦Copy of the national passport of the dependant .
◦Two passport size photos of the dependant.
◦Copy of birth certificate or marriage certificate for immediate family members If the institution is relatively new a copy of registration must be submitted together with the application .
FEE FOR DEPENDANT PASSES:

SPECIAL PASS:
This is a document issued to person(s) given specific employment by specific employer for a short duration not exceeding three (3) monthsose of receiving education or training at an educational or training establishment within the country by which he/she has been accepted as a student/pupil.
SPECIAL PASS REQUIREMENTS.
•Application form dully filled and signed
•Copy of the national passport
•Two passport size photos
•Forwarding letter from institution/applicant
•Clearance from regulatory bodies (medical and dentist board, pharmacy and poisons board, engineering board, NGO council, Ministry of Information. ion is relatively new a copy of registration must be submitted together with the application .

KENYAN PASSPORT:
Application Procedure
A Kenyan who intends to acquire or to travel outside Kenya shall submit an application for a passport in person to the Passport Control Officer in a manner as may be prescribed. Applications can be submitted at the Nairobi, Mombasa and Kisumu Passport Control Offices.
(A) Application for ordinary/ East African Passport (First application)
The applicant shall submit an application for the passport in person in the prescribed manner i.e. Form 19.
An application shall be accompanied by:-
• Documentary evidence of Kenyan citizenship i.e. Original & copies of birth Certificate and National Identity Card, or a Certificate of naturalization or registration and Renunciation Certificate of former citizenship. • Current clear and un-mounted three passport size photographs as may be directed by the Passport Control Officer.
• The Application must be recommended in section ‘7’ by a citizen of Kenya such as Minister of religion, a Minister or Legal Practitioner, an established Civil Servant or Bank Official personally acquainted with the applicant, but not by immediate relatives. The recommender must attach a copy of his/her National ID or passport.
• In the case of an applicant who is below the age of eighteen years, the parents or legal guardian’s written consent.
• In case of an applicant who is adopted, the original adoption certificate, clearance letter from the children’s department, and or, the Court ruling or award.
• Prescribed fee.
Note:
The Passport Control Officer may require the applicant for a passport to produce supplementary information so as to ascertain the citizenship or nationality of the applicant. These may include the applicant’s parent’s birth certificate, national identity card, or certificate of naturalization or registration.

(B) Application for Replacement of Passport
The applicant shall submit an application for the passport in person in the prescribed manner or form.
An application shall be accompanied by:
• The previous passport and copy
• Three (3) Recent clear passport size photographs (coloured)
• In the case of a diplomatic passport, a letter from the Chief of protocol from the Ministry of Foreign Affairs
• Prescribed fee
Note:
• The passport which was previously used and cannot be used any further shall immediately after the issuance of a new passport be cancelled by the Passport Control Officer.
• No person shall be issued with a new passport unless the application is accompanied by the previous passport.

(C) Application for Replacement of a lost or mutilated passport
The applicant shall submit an application for the passport in person in the prescribed form.
The application shall be accompanied by:-
• An affidavit of the circumstances surrounding the loss, theft, mutilation or damage.
• A police report on the loss of the passport
• Prescribed fee
Note:
To ascertain the true circumstances on the loss, theft or damage of the passport, the applicant may be required to appear for an interview before a Passport Control Officer.

(D) Application for Diplomatic passports
The applicant shall submit in addition to the requirements of ordinary passport a letter from the chief of protocol from the Ministry of foreign Affairs.

(E) Disqualification of application for passports
A Passport Control Officer shall disqualify the application of any person:-
• Who is not a citizen of Kenya
• Who gives false information for the purpose of obtaining a passport
• Submits incomplete forms
• In respect of whom there is evidence of involvement in passport fraud, passport forgery or international crime(s).

(F) Revocation of Passports
The Passport Control Officer may, where:-
• The holder of a passport or travel document permits another person to use his passport or travel document
• The holder of a passport has been deported or repatriated to Kenya at the expense of the government
• The holder engages in drug trafficking, money laundering, human trafficking, terrorist acts or any other illegal activity
• It is in national interest or national security
• It is discovered that a Kenyan over 21 years of age is a holder of a passport of another country
• The holder has a pending warrant of arrest, and
• The holder is a habitual criminal;
at any time withdraw, cancel or revoke the passport or travel document granted or issued to the holder.

3. An affidavit detailing the circumstances under which the mutilation occurred
4. Three coloured Passport size photographs of the applicant with one of photos duly certified as true likeness of the applicant by the recommender 5. Certified copy of the recommender’s National Identity Card
4. Replacement of Lost Passport

*Payment for lost and mutilated Passports are payable by banker’s cheque drawn in favour of Director of Immigration Services.

*Applicants under 18 years of age must have one of the Parents’/Guardians’ consent letter and a copy of the National Identity Card.

Passport Guidelines

PUBLIC NOTICE
We wish to further advice that Kenyan citizens who wish to travel to countries in the Far East e.g. Singapore, Thailand, Indonesia, or to countries in the Middle East e.g. United Arab Emirates (U.A.E) should ensure that they hold the new generation Passports (i.e. their passports should have been issued from March 2008 onwards).
VISAS:
VISA REQUIREMENTS
The attention of all applicants for visas should be drawn to immigration requirements set out below:
A. PASSPORTS
i. Valid passports or other travel documents including Seaman’s Discharge Book, acceptable to the Government of Kenya are required for all persons wishing to enter Kenya.
ii. Passports must be valid for at least Six (6) Months.
iii. Passports must have a clean and a full visa page for endorsement.
B. PERMITS OR PASSES
Subject to the exemptions mentioned below, an immigration pass or permit is required by all persons, other than Kenya citizens wishing to enter Kenya.
C. EXEMPTIONS
Exemptions from permits are granted to all persons who are entitled to privileges and immunities under The Kenya Citizenship and Immigration Act 2011 under section 34 (3) (a) to (g) laws of Kenya.
D. VISITORS
A bona fide visitor may be issued with a visitor’s pass on arrival at a port of entry into Kenya valid for a period not exceeding three months in the first instance provided that he is in possession of a valid passport or other travel document acceptable to the Government of Kenya, has a valid visa where required, is in possession of sufficient funds for subsistence while in Kenya and a return, or onward ticket to his country of origin, domicile or destination.
Nationals of East African Partner States holding valid passports and other acceptable travel documents may be issued with a visitor’s pass on arrival at a port of entry into Kenya valid for Six Months.
Travelers entering Kenya by road are advised to pass through the gazetted entry points and report immediately to an Immigration Officer.

SINGLE JOURNEY VISAS (SJV)
REQUIREMENTS,
Two visa application forms V.I to be duly filled, signed and dated.
Two copies of an Invitation letter/ Cover letter from the applicant.
Two copies of identity card if host is Kenyan.
Two copies of valid residential work permit if host is a foreigner.
Two copies of marriage certificate if visiting spouse.
Two passport size photographs of the applicant.
Two copies of valid Passport/travel document of the applicants Bio data page and page showing validity of at least six months.
Two copies of medical referral letter from a hospital or a doctor for medical cases.
Two copies of applicants residential/work permit if not residing in their country.
Referral fee is USD 10
SINGLE JOURNEY VISA APPLICATION FROM COMPANIES/ORGANISATIONS
REQUIREMENTS
Two visa application forms V.I to be duly filled, signed and dated.
Two copies of valid Passport with a validity of at least six months.
Two passport size photographs of the applicant.
Cover letters to be on company/organization’s letterheads.
Should specify the reason for applicant’s visit.
Specify proposed date of entry and duration of stay.
Show connection between applicant and the company/organization.
The letter should have the name and signature of the person countersigning it.
Single journey fee is USD 50
MULTIPLE JOURNEY VISAS (MJV)
REQUIREMENTS:
Two visa application forms V.I to be duly filled, signed and dated.
Two passport size photographs of the applicant.
Two copies of a Cover letter from the applicant detailing the need for an MJV.
Copies of previous visas.
Applicants applying for aMultiple Journey Visa to visit their spouses should avail in addition to the above, the following: –
Their spouses National identity Card if Kenyan
Residential/Work permit if spouse is a foreigner
Copy of marriage certificate
Parents applying for Multiple journey Visa’s to Kenya to visit their children in schools should avail copies of valid pupil’s passes and copies of valid residential permits in their countries of residence Fee is USD 100.
MULTIPLE JOURNEY VISA APPLICATION FROM COMPANIES/ORGANISATIONS
REQUIREMENTS:
Two visa application forms V.I to be duly filled, signed and dated.
Two passport size photographs of the applicant
Copies of previous visas
Two copies of a cover letter bearing the company/organization’s letterheads
Should specify the reason for applicant’s frequent visits
Show connection between applicant and the company/organization
The letter should have the name and signature of the person countersigning it.
Two copies of applicant’s resident permit if not residing in their country.
Fee is USD 100
TRANSIT VISAS
REQUIREMENTS:
Two visa application forms V.I to be duly filled, signed and dated.
Two passport size photographs of the applicant.
Two copies of valid Passport/travel document with a validity of at least six months.
Copies of onward ticket/itinerary to a third destination.
Transit Visa Fee is USD 20.

TYPES OF VISAS
a) Ordinary Visa: Issued for Single or Multiple entries to persons whose nationalities require visas to enter Kenya.
b)Transit Visa: Issued for periods not exceeding three days to persons whose nationalities require visas to enter Kenya and who intend to transit through Kenya to a different destination.
c) Diplomatic Visa: Issued for Single or Multiple entries to holders of Diplomatic passports who are on official duty.
d) Courtesy/ Official Visa: Issued to persons holding Official or Service passports on Official duty and to Ordinary passport holders who are not entitled to a Diplomatic visa; but where it is considered by the Director to be desirable on the grounds of international courtesy.
e) East Africa Tourist Visa: This is a joint tourist visa that entitles holders to travel to and within the Republic of Kenya, Republic of Rwanda and Republic of Uganda for the purpose of tourism.
Validity of East Africa Tourist Visa: 90 (Ninety days) Multiple Entry
Fee: US $100

The Immigration Officer at the port of entry may refuse such a person permission to enter if he is satisfied that such a visitor is unable to fulfil the immigration requirements and that the entry and presence of such a visitor, in Kenya would be contrary to national interests even though such a person may be in possession of a valid visa for Kenya, provided that any such refusal is consented to by the Director of Immigration Services Nairobi, his Deputy or Provincial Heads of Immigration at Mombasa, Kisumu, and Garissa or any other Senior Officer so authorized to deputize.
QUASI-CONSULAR AGREEMENTS (FUNCTIONS)
The Government of Kenya acts in a quasi-consular capacity on behalf of the following Commonwealth countries. ii. Wives and children accompanying such diplomats who fulfill the requirements of category 2 (c) above; and provided such persons, their wives and children do not fall under Section 33 (1) and (2) of the Kenya Citizenship and Immigration Act, 2011.
(d) Diplomats and government officials coming to Kenya to conduct official business or transiting through Kenya may be issued with entry/transit visas on application and without reference to the Director of Immigration Services, Nairobi, provided that:
i. Such persons produce documentary evidence of the nature of their official business or transit.
ii. Spouses and children accompanying such diplomats and government officials who fulfill the requirements of category 2 (d) above and provided such persons, their spouses and children do not fall under Section 33 (1) and (2) of the Kenya Citizenship and Immigration Act, 2011.
Note: Diplomats and government officials on private visits to Kenya and who are nationals of countries that require referred visas, shall have their visa applications referred to the Director of Immigration Officer, Nairobi, for approval, in the usual manner.

VISA FEES
• The transit visa fee shall be US $ 20.

Applying for a Birth Certificate
What you need to know:
Birth Registration
• Reporting of the occurrence of a birth must be done as soon as it occurs and not later than three months after occurrence. The report is made to area Assistant chief’s office if the birth occurs at home and to the hospital personnel if the birth occurs in a hospital.
• Assistants Chiefs or Hospital personnel issue you with a birth reporting receipt called Acknowledgement of birth Notification (ABN) free of charge
Where to apply for a birth certificate
• Applications are made at the district registrar’s office and certificates issued from the same office
• However parents and guardians of pupils/students are advised to visit school head teachers of their children where they can be advised on the process of applying for the birth certificates. Head teachers have been allowed to assist parents in the processing of birth certificates for the pupils.
• Applications can also be made at the office of the local assistant chief
How to Apply
1. Where the child was registered at birth (Current registration)
• Obtain a birth certificate application form from the head teacher, Assistant chief or from the District Civil Registrar at the District Commissioner’s office.
• After filling the form, attach Acknowledgment of birth notification (ABN) of child to facilitate search of the birth record at the District Civil Registrar’s office
• Where the birth notification is missing, attach the child’s clinic card that shows exact place and date of birth
• Attach birth certificate fee of Kshs. 50 and any record amendment fee as advised by the office in case amendments are required on the original record of birth.
• Return the completed birth certificate application form with the relevant fee to the head teacher, Assistant chief or the District Civil Registrar at the District Commissioner’s office.
• After seven days from the date of submission, return to where you submitted the forms to collect your certificate
2. Where the child was not registered at birth (Late Registration of a Birth)
• Obtain a birth certificate application form from the head teacher, Assistant chief or from the District Civil Registrar at the District Commissioner’s office.
• After filling the form, attach relevant supporting documents, which includes, but not limited to the following:
• Clinic card OR baptismal/dedication card OR School leaving certificate OR all if available
• In the absence of an existing document showing the date of birth, a letter from the head teacher indicating date of birth as declared during admission to the school should be attached to the application
• Identity cards of parents OR death certificates if deceased or an Assistant chiefs letter if they are deceased and a death certificate is unavailable
• Return the completed birth certificate application form with certificate fee of Kshs 150 to the head teacher, Assistant chief or the District Civil Registrar at the District Commissioner’s office
• After seven days from the date of submission, return to where you submitted the forms to collect your certificate
3. Registration of Street Children and Orphans Registration Requirements
• Committal documents from a court indicating that custody of the child has been duly granted.
• Letter from the Children’s Department indicating that the child in question is indeed abandoned
• In addition to NO 2 above, if the child is housed by an Institution such as children homes, a letter from the institution, providing the child’s history including the date of birth according to an age assessment test must be provided.
• Police report where the report was made when the abandoned child was found.

Applying for Death Certificate
Death registration
Reporting the occurrence of a death must be done as soon as it occurs and not later than one month after occurrence. The report is made to the area Assistant Chief’s office if the death occurs at home and to the hospital personnel if the death occurs in hospital. The Assistant chief or the hospital personnel issue you with a burial permit free of charge.

Applications are made at the District Registrar’s office and certificates issued from the same office.

2. Where the death was not registered at occurrence (late registration)
• Obtain a late registration of death form the District Registrar’s office at the District Commissioner’s office
• After filling the form, attach the relevant supporting documents, which include: Letter from Assistant Chief where the death occurred
• Sworn affidavit
• Deceased’s national identity card
• Letter from the hospital where the death occurred
• Applicants national identity card
• Return the completed death certificate application form with a certificate fee of Kshs. 150 to the District Civil Registrar at the District Commissioners’ office

Registration Processes
The Act postulates that Registration of these events should be done before expiration of six and three months of the occurrence of birth and death respectively. Registration after six months which is considered late as per Act is done at the discretion of the District Registrar and after production of the required documents.
Where it occurs in a health institution, the event is notified to the officer-in-charge of the institution who similarly submits to the local district registrar. For this reason, the hospital staff and assistant chiefs have been designated as registration assistants. They are accordingly supplied with registration forms and are required to submit completed registration forms to the district registrar every month or such shorter period as the registrar may prescribe in the case of busy hospitals.
Once the forms are submitted to the District Registrar, he checks them for correctness, and if satisfied, gives each form a registration number and signs it. It is the act of numbering (giving the record a unique number) and signing the record that completes the process of registration. A separate series of registration numbers of births and deaths is started at the beginning of each year. Accordingly, it is the number and year that identifies each registered event.
For each birth or death, a registration form known as the birth or death register is completed in duplicate. One copy is retained in the district treasury and the other copy is dispatched to headquarters. The District Registrar is required to preserve and secure all the copies retained in the registry. It is from these records that birth and death certificates are prepared and issued. The central records registry at the headquarters keeps every duplicate as a back-up record.
Agents for Registration
Birth and deaths registration is done by two agents: the Provincial Administration and the hospital personnel. The provincial administration registers events that occur at home while the hospital personnel register events that occur in hospitals.
